By accessing or using the Zianus website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Zianus provides BaZi (Four Pillars of Destiny) reading services based on your birth data. Our Service uses a combination of traditional Chinese astrological calculation engines and AI-powered interpretation to generate personalized readings.
We offer two tiers: a free preview (showing your Four Pillars and basic summary) and paid readings (Essential at $19 and Complete at $99) that provide detailed analysis.
3. Entertainment Purposes Only
Important: All readings provided by Zianus are for entertainment purposes only. BaZi readings do not constitute professional advice of any kind, including but not limited to medical, legal, financial, psychological, or relationship advice.
You should not make life-altering decisions based solely on the readings provided by our Service. Zianus does not guarantee the accuracy, completeness, or reliability of any reading. Results are interpretive and subjective, and should be treated as such.
4. Age Requirement
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are 18 years of age or older. If we discover that a user under 18 has provided personal data, we will delete it promptly.
5. User Data
To generate a BaZi reading, we collect the following data:
- Date of birth
- Time of birth
- City of birth (for timezone correction)
- Gender (affects luck cycle direction in traditional BaZi)
This data is used solely for generating your reading and is not persistently stored on our servers. For full details, please refer to our Privacy Policy.
6. Data Processing
By using our Service, you consent to the processing of your personal data as described in our Privacy Policy. Key points:
- Your birth data is processed solely for generating BaZi readings
- Data is not persistently stored on our servers
- Third-party processors (FreeAstroAPI, DeepSeek, Vercel, Lemon Squeezy) process data per their own policies
- International data transfers occur as described in our Privacy Policy
For EU/EEA users: We act as a data controller. Our legal basis for processing is your explicit consent when you submit birth data, and legitimate interest in providing the paid service. You may withdraw consent at any time by contacting privacy@zianus.com.
7. Payments and Refunds
Paid readings are processed through our payment provider (Lemon Squeezy). All prices are listed in US Dollars. Refund eligibility is governed by our Refund Policy. By completing a purchase, you agree to the applicable pricing and refund terms.
8. Intellectual Property
All content on the Zianus website, including but not limited to text, graphics, logos, icons, images, and software, is the property of Zianus or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without our express written permission.
Your personalized reading content is provided for your personal, non-commercial use. You may share excerpts for personal purposes (e.g., with friends or on personal social media), provided you do not misrepresent the content as professional advice.
9. Prohibited Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the Service
- Use automated tools (bots, scrapers) to access the Service
- Resell or redistribute readings without authorization
- Misrepresent reading content as professional advice
- Submit false or inaccurate birth data intentionally
- Attempt to overwhelm or disrupt the Service infrastructure
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. BaZi readings are interpretive and subjective; we make no guarantees regarding their accuracy or applicability to your life circumstances.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIANUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to Zianus in the 12 months preceding the claim, or $100 USD, whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Zianus, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
